Table Seven Seeking Change For “At Will” Clause.

Hello everyone.  If you’ve been following my blog, then you’re probably aware that we’re based in Pennsylvania, but personally, I’ve been living here since 2012.  As I’m slowly finding out, certain things are done differently here, especially when it comes to working and the relationships between employer and employee.

Employment at Will in Pennsylvania: The Basics

Since 1891, Pennsylvania has subscribed to the theory of employment at will. Thus, as the court noted in Stumpp v. Stroudsburg Municipal Authority 540 Pa. 391, 396 (1995), “as a general rule, employees are at-will, absent a contract, and may be terminated at any time, for any reason or for no reason.”

The above article was copied from the site, corporate.findlaw.com

This clause has been a real issue for me for the last two years.  Twice, I was fired from a place of employment for no reason at all.

I’m definitely going to get into the details a little later, but for now I’m going to keep it simple and tell you why I have a problem with this.

You could say that I’m upset because I was fired no reason, but the real issue here is that employers are using the At Will Clause/law as a shield.

You see, you cannot fire a person based on sex, race, religion, color, sexual preference, etc., but in Pennsylvania, they can and do and then hide behind the At Will Clause.

It is my belief that I was fired from the preschool I was working at because I was a man, but because of the At Will Clause, I didn’t have a leg to stand on.

If I had my way the At Will Clause would be removed, forgotten about, and never used again, but I’m going to need help.

DECEITFUL, ENVIOUS, JEALOUS, HATEFUL, and RACIST people who are also you’re bosses and managers are hiding behind the At Will Clause.

Lets hold these people accountable, and lets see why people like myself are really getting fired.  Is it really just because they felt like it?

Write in let me know what’s up especially if you live in Pennsylvania and have been affected by this.

I’m not lazy.  I’m not looking for a reason not to work, but for some reason, keeping a job has been difficult.  I’m passionate, punctual, educated, and I work very hard.  I haven’t given any employer a reason to fire me, but it’s not like they need one.

Court Response; Way Too Coincidental

In January 2019, I decided I wanted to become a teacher again, but I don’t live in New Jersey now, I live in Pennsylvania.  In New Jersey, I already completed the Master’s Courses for a Teaching Certification in Early Childhood Education, and that was in 2007, but because I’m in a different state, different rules apply.

I tried to apply to the Master’s Program at Cedar Crest College, and they rejected my application.  Unbelievable!?!?

Anyway, I thought it would be a good idea to substitute teach because it would give me a chance to get some classroom experience again, and I could meet teachers and other professionals in the school system.  Perhaps, this would increase my chances of getting accepted into a Master’s Program, and I could get my Pennsylvania Teaching Certification.

I applied to the Substitute Teacher Service in March 2019, and part of that application process was a criminal background check, an FBI background check, and Child Abuse History Clearance, a TB Test, three references, and college degree, and the list goes on.

During my interview with STS, they said I might not be hirable until the school year of September, 2020 because I had a misdemeanor on my background check.  They said the law/rule is that if you have a misdemeanor 1, you have to wait 5 years until you can be cleared to teach.  I didn’t have a misdemeanor 1.

My paperwork went through, and STS hired me in April 2019, and I worked in the Allentown School District for the remainder of the school year.

In August 2019, I got an email saying that a company named ESS was taking over the Allentown School District account and STS was no longer in service there.

So now, I work for ESS as a substitute teacher in the Allentown School District, but I’m still an employee of STS.

I asked the person who hired me at STS if I could work in the Bethlehem School District since the Substitute Teacher Service still had that account, and she said she would forward my paperwork.  When she got back to me, she informed that Bethlehem wasn’t going to allow me to work in their district until the school year of 2020 because I had a misdemeanor on my background check.  She said I had to wait 5 years.

I argued back.  I told her we already covered this issue when you hired me.  Why is it an issue now?

She said Bethlehem reserves the right to choose who they want to work in their district, and I said, maybe that’s true, but you’re telling me they’re not hiring me because of the misdemeanor on my record.

Long Long story short, I called an attorney because I wanted to sue the Bethlehem School District and the Substitute Teacher Service for not letting me work during the 2019, 2020 school year.  That was two days ago.

Last night I had a dream that I was shitting in a stall with no door on it in front of the courtroom in Allentown  Everyone in court was laughing at me and the judge was taking pictures.

Today, I got served a letter that I owe the State of Pennsylvania 8,500 dollars.  I’m not really sure what that’s about, but that seems really coincidental.

Write in, and let me know what you think.  Alright everyone, have a good day.

Time To Be Frank, or whoever you really are.

Somewhere during the last twenty years, I lost myself,  I lost everything that made me, me.  I lost whatever made me Frank.

When you’re lost or lose yourself, you’re no longer a leader, therefore, you’re easily led.  If you don’t wake up, you drift further and further from your center because you’re being led astray.

In the absence of my shit, I’ve explored, I’ve experimented, and I’ve talked to people that otherwise, I wouldn’t have spoken to.  In the end, I became good.  Just good.  I immersed myself in studies and learned all about astrology, numerology, spirituality, meditation, and so on.  In doing so, I found something I was passionate about.

No more taking the wheel with the windows down on a hot summer night.  I traded in the Caddy for a station wagon  so-to-speak.  No more arrogance, no more outspokenness, no more Frank.  More listening, and less talking.

But… where has being good got me?  It’s gotten me ignored, it’s hard to find a job, and I haven’t had a romantic partner in seven years.  I bite my tongue now, and try my best to speak the truth.

People treat me differently because I’ve become a different person, but you see, there has to be a balance to this, and what I’m finding out is that people will shit, shit, and shit all over you as long as they feel like they can get away with it, and believe me, I’ve let people get away with some shit.  No more however, no more.

I’m not asking for anything anymore, because at this point, I almost don’t care.  If my life never turns out the way I thought, expected, or hoped,  than I guess it wasn’t meant to be, but…..

…..no matter how scared I may be, I will never be controlled by fear.

Wait A Second, Who Are You?

I’m not going to name names, but the person I’m speaking about has been in the news lately, and her “mission” is touching millions of people across our country.  She is a female, she is under the age of 18, and she seems to be be really concerned about global climate change.

If someone showed up at your doorstep and began ringing your doorbell, would you let them in?  Keep in mind, you don’t know this person, and you’ve never met them.  Well, I would hope not, but of course, our country has welcomed the minor with open arms.

The fact that she has sailed here across the ocean by herself in a solar powered row boat is really interesting.  Doesn’t she have school though?

It makes me wonder?  Is she running from someone or something?  Does she have a disease that could infect the entire American population?  Has she been exiled?  Who is she really?  Does she have a birth certificate?  (oh wait a minute, that’s why OBAMA fist bumped her, they have something in common.)

What’s her real name?  Is she a symbol of world peace?  Does she really care about the temperature of the planet?

If, and I’m saying if, she sailed across the ocean alone, that’s very brave of her, and I admire her for having “that get up and go” mentality, but to look at her, she doesn’t seem really passionate at all about the topic of which she speaks.  They say she’s swiss, but that’s only because she looks like the “Swiss Miss Hot Chocolate Girl” with her braids.  I think she’s German.  Something isn’t jiving.

That’s just my opinion.

Alright Everyone, Have A good Day!  Write in, and let me know what you think.

NCAA College Football Feature Follow-up

Sunday, September 22, 2019.

First things first, money, right?  Okay, we gave you SMU getting 9.5 points.  THEY COVERED.!!🎆🎇🎉🎊💲  https://noozbuffet.com is now 2-0-1 versus the spread.

SMU did the unexpected.  They traveled to Fort Worth as 9.5 point underdogs, and beat (25)Texas Christian 41-38.  We knew SMU was outscoring opponents 35-6 in the first quarter, and of course, playing on the road this week, we stressed the importance of them getting off to a fast start.

Boy oh boy, they didn’t disappoint us either.  SMU QB Shane Buechele rushed 4 yards for the Mustangs first touchdown.  Then, TCU fumbled the ball on their own 1 yard line, and SMU recovered.  On the ensuing drive, Xavier Jones rushed 1 yard for the Mustangs second touchdown, and it was 15-0 just like that.  When the first quarter ended, SMU was winning 18-7.  They scored early and often.  Mission complete.

Shane Buechele did throw an interception, but he also threw for 288 yards and two touchdowns.  His completion percentage was almost 70%.  On the ground, Xavier Jones did carry the load.  He touched the rock 19 times, and had 79 yards and a touchdown.  (that’s a little over 4 yards per carry)  Not bad at all.

TCU never really did rebound from that first quarter.  They trailed the entire game despite scoring 21 points in the second half and almost making a comeback.  I don’t know what happened to that two-headed monster in the backfield, but Darius Anderson did some serious damage.  He rushed for 161 yards and 2 touchdowns.  The Horned Frogs did a really good job spreading the ball around.  Eight different receivers caught passes, but Pro Wells stood out with 2 td’s.

We said when it was all said and done, only one team would remain undefeated.  The SMU Mustangs are now 4-0.  I really thought this win would spring them into the NCAA Top 25, but I guess voters aren’t giving them that much respect yet.

I don’t know WTF these people look at.  UCF loss to Pitt and they’re still in, Army’s in with one loss, and Michigan has one loss.  They’re even considering one-loss Iowa State for the 25th spot.

I hope everyone had a wonderful Saturday, and we’ll see y’all next week.  Don’t forget, every Thursday we post the Table 7 Top 6, at 6am, and the Nooz Buffet NCAA College Football Feature Game of the Week analysis is up by 3pm.

Week 4, Ncaa College Football

Table 7 Top 6

  1. (11)Michigan @ (13)Wisconsin- This classic Big 10 match-up kicks off at 12 noon on Saturday.  Both teams are undefeated.
  2. Tennessee @ (9) Florida- Tennessee travels to the swamp to play the Gators this weekend, but those Gators are hot and hungry with wins over Kentucky and Miami.  Florida is undefeated, Tennessee on the other hand, well, they’re still looking for their first win.  Won’t be this week.
  3. Boston College @ Rutgers- This is another game that kicks off Saturday afternoon at 12.  B.C. will be traveling to my home and native land, New Jersey, to play the 1-1 Scarlet Knights.  Last week Rutgers had a bye, which is good.  Hopefully they took advantage of that extra time to prepare.  Boston College lost last week 24-48 against Kansas so this is an important one as I’m sure they’ve already had a “w” penciled in. Shhh!  Upset?  I hope.
  4. SMU @ (25) TCU- Last week, TCU was victorious over Purdue, 34-13, while SMU enjoyed the weekend off.  The last time SMU played they bitched whipped North Texas 49-27.  SMU and TCU are both undefeated, but a slight edge will be given to TCU because after-all, they’re playing home.  TCU is ranked 25th, and that’s good for SMU as a win would bring them some much needed respect and recognition.  This should be a really good game.
  5. (15) UFC @ PITT- I don’t know for a fact, but I’m pretty sure Central Florida plays every week with a bit of a chip on their shoulder because of the way they’re treated when playoff time rolls around, and rightfully so.  They’re one of several teams that get railroaded despite having a perfect record.  Right now, they’re fast off to a 3-0 start, which includes last week’s 45-27 win over Stanford.  Coach Narduzzi and his Pittsburgh Panthers lost 10-17 to in-state rival (13)Penn State last week.  I like Pitt, I sincerely do, and I hope they continue to get better and win games, but right now they’re not at the Penn State level.  I hope they’re over it, and focused on UCF because this game won’t be easy for them.
  6. (7) Notre Dame @ (3) Georgia- Kick off time is Saturday evening at 8pm, and the Georgia Bulldogs are home.  Both teams are undefeated and both won last week in blow out fashion.  Showtime!

Inhale, Don’t Inhale?

I don’t know the first thing about vaping or electronic cigarettes, but I’ve seen both getting a lot negative publicity lately in various news sources.

According to an article published in the Morning Call yesterday titled, Lung disorder hits Valley,”  St. Lukes, a local hospital, is beginning to treat people with injuries related vaping.  To be exact, they’ve treated half a dozen people with severe lung issues over the last several months.

Health officials have even taken steps to send speakers to middle schools and high schools to speak to young students about the harmful side effects that could possibly be related to e-cigarettes and vaping.

In addition to lung disorders, fatigue, coughing, vomiting, and shortness of breath have also been seen as side effects.

Like I said, I don’t much about this, but it did just seem to come out of nowhere.  All of a sudden people were walking around with electronic cigarettes.  Some said it was an alternative to smoking “traditional” or nicotine packed cigarettes.

I think it’s fair to say the worst it yet to come in terms of illnesses and side effects if vaping is fairly new.

I took some time this morning to interview Ray, the manager of Vapor Galleria, a local Vape shop in Pennsylvania.

Ray said he has been in business for five years at his location on Broadway in Allentown.  He also said business has been good and the recent publicity vaping and electronic cigarettes have gotten has not affected his sales.

“We haven’t had any issues here,” said Ray, “all of our juices are manufactured by us in Oklahoma CIty.  I think a lot of the issues are happening when people buy black market Juices.”

“Juices” are the actual substances people are inhaling.  (I just found that out, lol)

So yes, there is a black market for vape juice.  Not everyone who’s vaping or using electronic cigarettes are doing so as intended.  Some people are experimenting and using their own substances, which adds a completely different dimension to this in terms of related illnesses and side effects.

Alright everyone, be smart, and be careful.  Don’t vape weed, crack, or whatever the hell else you’re inhaling.

Have a wonderful day.

Kentucky Blows It In Final Seconds

You could actually say the wind blew it because the winning kick sailed wide right with like :43 left on the game clock.

Good Morning NJ, PA, and the rest of the world.  I hope everyone has a wonderful day to today with it being Sunday and all.  Some people work today, some don’t, but what’s important is that we’re doing whatever it is we would like.

I don’t know how many people actually watched the Florida Gators play Kentucky last night, but it was a fabulous game as expected.  I said Kentucky would show up at night, at home, and win this game, but they ended up loosing 29-21.  If you took Kentucky with the 8 points then at least you didn’t lose any money.

I know some people got the spread at 9.5 so congratulations to all of you.

I was a 22-21 ball game with just under a minute left to play.  Kentucky drove the ball down the field in dramatic fashion, and on fourth down, special teams came on the field to kick the potential game winning field goal.  The Wildcats missed the kick and turned the ball over on downs.  Then Florida put the nail in the coffin with another touchdown run that went for 76 yards, and the extra point was good.

When the final quarter bagan, Kentucky was winning this game 21-10, but the Wildcats didn’t score any points in the fourth quarter.  In fact, they were leading the Gators 21-16 all the way up until…

Florida intercepted a pass at the six minute mark, and on their possession, the backup QB, Trask, ran it into the endzone for six.  Florida went for two but failed to convert, and the score was 22-21, which is where it stayed until the  final minute.

Florida is now 3-0 and ranked first in the SEC East, while Kentucky fell to 2-1.  They’re ranked fifth in the same division.

Wait, what?  Hawaii?  I don’t know.

Noozbuffet.com is now 1-1 with Feature Game Picks.
